The Problem of Avian Abuse

 

One this site we will post pictures of avian abuse, and resources available to you to help deal with this problem, and bring the perpetrators to the attention of authorities.
Here's some information from Washington law:
  • "Animal" includes birds (not true in some states!)
  • "Necessary food" is defined as "the provision at suitable intervals of wholesome footstuff suitable for the animal's age and species and sufficient to provide a reasonable level of nutriton" (Wash. Rev. Code Para.16.52.011g, 1994)
  • confinement of any animals "that will jeopardize the safety of the animal or the public" is a misdemeanor
  • "Unnecessary suffering or pain" is cruelty in the second degree (16.52.207, 1994)
BAD NEWS: "it shall be an affirmative defense...that the defendant's failure was due to economic distress" beyind their control"
"If a LAW ENFORCEMENT OFFICER or an ANIMAL CONTROL OFFICER has PROBABLE CAUSE to believe a violation of this chapter has occurred, the officer may authorize a examination of a domestic animal allegedly neglected or abused...by a veterinarian"

"The officer may authorize, with a warrant, the removal of the animal to a suitable place for feeding and care" (16.52.085). AN OFFICER MAY REMOVE AN ANIMAL UNDER THIS SUBSECTION WITHOUT A WARRANT ONLY IF THE ANIMAL IS IN IMMEDIATE LIFE-THREATENING CNDITION." [caps mine]

"Animal control officers have the following enforcement powers...:

  • issue citations
  • cause a law enforcement officer to arrest
  • make an oral complaint to a prosecuting attorney
  • prepare affidavits in support of search warrants
"An owner of an animal is guilty of animal cruelty in the second degree if..."FAILS TO PROVIDE THE ANIMAL WITH NECESSARY FOOD, WATER, SHELTER, REST, SANITATION, VENTILATION, SPACE, OR MEDICAL ATTENTION AND THE ANIMAL SUFFERS UNNNECESSARY OR UNJUSTIFIABLE PAIN AS A RESULT" [caps mine]
